1. Objective

This site is published by Media Assurances SA whose registered office is located at 43, boulevard Pierre Frieden in 1543 Luxembourg (Grand Duchy of Luxembourg).
The purpose of this section is to inform you as to how we, in the capacity of Controller, comply with the General Data Protection Regulation, better known by the acronym “GDPR”.
More specifically, this section describes how we manage your personal data and ensure their protection within the framework of European Regulation 2016/679 of 27 April 2016 on the protection of personal data and their free movement, as well as relevant national laws and regulations.

2. What type of data do we collect?

It includes the following:
  • your IP address
  • the date and time of your access to our site
  • the language you chose to browse the site
  • your identification details (first name, last name, title, postal address, e-mail address)

3. On which legal basis and for what purpose do we collect your data?

3.1 Purposes that are in our legitimate interest

We collect your data mainly to:
  • allow you to access the site and use its services
  • improve the services provided by the site
  • facilitate communication between you and us
  • keep you informed by sending emails, newsletters, information letters
  • process your orders and receive your payments

3.2 With your consent

Insofar you have given us your consent for the processing of personal data, such consent will serve as a legal basis for the referred processing. This includes your potential consent that you may have given to be contacted by email or through other means for offers and promotions (.e.g. about products and services of members of the Media Assurance group or those of our commercial partners).

3.3. Legal or regulatory obligation

We can process your personal data where it is necessary for compliance with a legal or regulatory obligation that we are object to, notably when responding to requests by government or law enforcement authorities conducting an investigation.

4. In what ways do we collect your data?

We receive and collect the data directly from your use and browse of our site.

5. Are your data protected?

We maintain a strict privacy policy and take all appropriate measures to ensure that our servers prevent, as far as possible, any unauthorised leakage, destruction, loss, disclosure, use, access or modification of your data.

6. How long do we keep your data?

We retain your data as long as necessary for the fulfilment of the objectives pursued and/or according to the legal constraints. Once these objectives are achieved and/or the legal constraints no longer applicable, we delete them by anonymisation.

7. What are your rights and how can you exercise them?

Pursuant to the GDPR, you have the following rights:
  • the right to access your data, free of charge, within reasonable intervals and in a timely manner, as well as all information on the origin of such data;
  • the right to have inaccurate or redundant data rectified or erased;
  • the right to request the erasure of your data without undue delay when the use or other processing of such data is no longer necessary for the purposes described above, and notably when consent relating to a specific processing has been withdrawn or where the processing is not or no longer lawful for other reasons;
  • in cases where the accuracy of the data is contested, the processing is unlawful, or where the you have objected to the processing of your data, you may ask for the restriction of the processing of such data. This means that the data will, with the exception of storage, only be processed with or for the establishment, exercise or defence of legal claims of Media Assurances, for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State. In case a processing is restricted, you will be informed before the restriction of processing is lifted; and
  • the right to data portability where the processing is based on the execution of a contract or consent, is performed by automated means and where the data has been provided by you.

In addition to the rights listed above, should you consider that we do not comply with the applicable privacy rules, or have concerns with regard to the protection of their Personal Data, you may file a complaint with the Luxembourg data protection authority (the Commission Nationale pour la Protection des Données – CNPD) or another data protection authority in the European Union (for instance in the Member State in which you reside).

8. Who has access to your data and to whom are they communicated?

Our employees and subcontractors. They have access to the data only to the extent necessary for the achievement of the objectives pursued above. Each of them is subject to a strict obligation of confidentiality.

9. Do we transmit your data outside the European Union?

Your personal data are hosted in a European Union country, and are not transmitted outside the European Union.

10. What is our policy regarding data concerning minors?

Our site is not intended for children under 18 years of age. If you learn that your minor child has provided us with their personal data without your consent, contact us at the following address: info@media-assurances.com.

11. What happens when there is a policy change?

If we are required to change this policy, we will notify you using the most appropriate means, including email, our website or other means of communication.

12. What to do in case of dispute?

In the event of a dispute between us, we give preference to dialogue and openness for finding an amicable solution. If no amicable agreement is reached, the Luxembourg law is applicable and the French-speaking courts of Luxembourg shall have exclusive jurisdiction.
